DAVENPORT, Iowa — The corporate owner of a Davenport mobile home will pay a$20,000 civil penalty due to issues with their water supply and wastewater treatment.
Through a consent degree entered this week, Peeters Development Co Inc – owner of Mt. Joy Mobile Home Park – must pay the penalty to the state and is subject to a permanent injunction regarding their public water supply and wastewater treatment plant operations, which serves approximately 170 people.
The decree is due to a lawsuit stemming from a series of violations that happened from 2013-2015. Violations include failing to properly maintain the public water supply system, exceeding the allowed levels of arsenic in water, failing to notify residents about excess levels of arsenic, lead, copper nitrates and coliform bacteria in the water that were not properly monitored.
The wastewater treatment plant also was in violation due to failing to properly operate and maintain the plant, failing to retain a properly certified plan operator, and exceeding wastewater effluent limitations.
The permanent injunction bars Peeters from violating certain environmental laws and regulations at its public water supply and wastewater treatment plants. The agreement requires Peeters to retain a properly certified plant operator and professional engineer to assess the plant, submit a compliance plan to the Iowa DNR, and complete the necessary improvements by Oct. 1, 2020.
