Mom says man who killed her daughter should not have been in US

A Moline man who confessed to killing his girlfriend and burying her body will not be allowed to take back his guilty plea.

ROCK ISLAND, Illinois — A Moline man who confessed to killing his girlfriend and burying her body will not be allowed to take back his guilty plea.

Attorneys for Osbaldo Jose-Nicolas filed a motion for post conviction relief, alleging that he had tried to retract his plea 8 years ago.

The judge today said there was no evidence to back that up, and denied the motion.

Jose-Nicolas had confessed to strangling Christina Mejia and burying her body in Cordova in 2007.

Her mother and sister and other family members cried in court when the judge announced his decision.

"I'm happy. He's not going anywhere. We miss Chrissy every day. Her kids are suffering. They're the ones that hurt the most", said her mom, Paula Murphy.

Her sister, Amanda Hawkins, has custody of three of the children.

"They've grown up without their mother and two of them will never know their mother. They were babies", said Hawkins.

Jose-Nicolas used a Spanish speaking interpreter in court.

Mejia's family says he was in this country from Mexico illegally, and had been working at Tyson Foods in Joslin at the time of the murder.

"Him and his sisters and brothers were here illegally, and he's still here illegally, unless he was granted citizenship in prison. How can he have more rights than we do? Who is paying for all of this? The United States is paying for all of this. And, we're paying the price, too", she said.

Jose-Nicolas was escorted by prison guards back to Menard Penitentiary, where he is slated to serve 34 more years in prison.
