Former Muscatine police officer found guilty of sexual assault

Prosecutors say Martin was impaired and out of it when the officer preyed on her, then lied about it to investigators.

MUSCATINE, Iowa — A jury has found former Muscatine police officer guilty of sexually assaulting a Davenport woman while he was on duty.

Tom Tovar, the married ex-police officer accused of raping a very intoxicated woman while he was on duty testified that the sex was consensual. He gave Shari Martin a ride in his squad car to her hotel after her boyfriend was arrested for drunk driving.

It's in the hotel room that Tovar says the two had consensual sex. Martin says she woke up and could only remember a uniformed man on top of her.

Both took the stand this week during the trial.

Prosecutors say Martin was impaired and out of it when the officer preyed on her, then lied about it to investigators.

Tovar faces a mandatory ten years in prison. He resigned from the department shortly after his arrest in 2013.
