DOWNERS GROVE, Ill. -- A woman from Ohio is once again suing a sperm bank in Downers Grove, accusing the company of mistakenly giving her sperm from a black donor, reports WGN.
Jennifer Cramblett, who's white, gave birth to her mixed-race daughter Payton three years ago.
Cramblett and her same-sex partner ordered the sperm of a white donor in September 2011, but the Midwest Sperm Bank sent her the wrong vials.
The sperm bank did apologize for the mix up and refunded her money.
But in the new lawsuit, Cramblett says the sperm bank committed fraud.
The suit says Midwest Sperm Bank's staff was not properly trained and didn't label samples correctly.
Her first lawsuit was dismissed.
