CHARLES CITY, Iowa (AP) — A Charles City man is scheduled to be resentenced Thursday for killing his 3-year-old cousin.
Authorities say Edgar Concepcion Jr. was 14 when he killed Krystel Banes in 2009. He was sentenced in November 2010 to life in prison without the possibility of parole.
The Iowa Court of Appeals later upheld his convictions but overturned his sentences. The U.S. Supreme Court has ruled that such life sentences for juveniles are unconstitutional, so Concepcion must be resentenced.
