Victim’s mom shocked after court grants new trial in deadly drunk driving crash

The mother of a young woman killed in a 2013 drunk driving crash is speaking out, now that the driver in the accident is being granted a new trial.

The mother of a young woman killed in a 2013 drunk driving crash is speaking out, now that  the driver in the accident is being granted a new trial.

Mitch Gayer, 25, pled guilty in May and was later sentenced to 18 years in prison. The crash killed Jamie Sedam, 22,  and Clayton Carver, 24.

But last month, Gayer hired a new attorney and asked to take back his plea of guilty.

Judge Tom Berglund has now ruled in his favor.

Sedam's mother is in shock.

"Here it is, two-and-a-half years later, and we're back to square one? What in the heck is going on? The facts are, you drank, you drove, you killed two people. You're guilty," said Tracey O'Hara, at her home in Port Byron, Illinois.

Gayer contended his former attorney, Gerry Schick, never advised him of the potential penalties in pleading guilty to the offense.

The judge also wrote that he noticed Schick falling asleep during Gayer's sentencing hearing.

A hearing to set a new trial date has not been set.
