A Louisa County deputy will not face criminal charges after he shot a man following a pursuit.
Deputy David Perley shot 55-year-old Richard Spurling after deputies tried to get Spurling to pull over late Tuesday night, June 9, 2015. Spurling allegedly led police on a short pursuit that ended on Crimson Avenue, where Spurling allegedly drove his car toward an approaching deputy. That’s when Perley fired his gun at Spurling; Spurling was shot in the upper torso and his injuries were considered non-life-threatening.
State police investigated the incident, and forwarded their findings to Muscatine County Attorney Alan Ostergren for a decision on whether Perley would face any charges.
Ostergren said Perley's use of force was appropriate.
After a review the Muscatine County Attorney has determined that the use of deadly force by Deputy Perley was lawful," said a statement issued by Ostergren onJune 24.
Spurling still faces criminal charges in connection with the incident. Police previously said Spurling faced charges of operating a motor vehicle while intoxicated, eluding, possession of drug paraphernalia, and misdemeanor traffic offenses.
