(CNN) — The Idaho man accused of slapping a crying 19-month-old boy on a Delta flight will plead not guilty, his attorney said Wednesday.
Joe Rickey Hundley, who is charged with assaulting a minor in connection with the incident last month, was scheduled to appear in a federal court in Atlanta on Wednesday afternoon. Accompanied by his attorney outside the courthouse, Hundley appeared solemn and looked toward the ground.
His attorney, Marcia Shein, declined to answer reporters’ questions about how her client was doing, but said he would be entering a plea of not guilty in court.
