In the four months since he had taken over the Kristin Holzman case, Attorney Jack Schwartz has filed three motions delaying her trial.
His most recent coming Monday, December 5, 2011, in what was supposed to be a change of venue hearing.
"We filed a motion to substitute Judge Stengel for cause based on a ruling he made on a different case which is people vs. Griffin," said Schwartz.
According to court documents, Holzman says she believes Judge Casey Stengel is prejudice against her attorney, blaming unreasonable Attorney fees from a 2010 drug case.
Judge McReynolds denying the motion for a substitute judge, leaving Stengel on the case.
"We are going to look at filing a interlocutory appeal," said Schwartz.
Monday's curve ball is the third Schwartz has thrown. In October he filed a motion stating a conflict of interest with State's Attorney Terry Patton after his involvement with one of Holzman's alleged victim's, Rebuilding Together.
The judge appointing special Prosecutor Jeff Lang.
"My firm Land and Waterman and I are always receptive if a court calls and asks us to perform public service," said Lang.
In September he filed a motion requesting a change of venue citing too much media attention, pointing fingers directly at News 8.
Schwartz still hoping for a change of venue.
"We would prefer it be moved to somewhere like Rock Island, Mercer or Whiteside county," said Schwartz.
Holzman's next hearing is scheduled for Friday, December 9, 2011.
